Mobile Terms of Service

John Hardy (“John Hardy,” “we,” or “us”) offers a mobile message service (the “Service”). The Service allows users to receive SMS/MMS marketing text messages (“Promotional Messages”) and information related to their interactions and transactions with John Hardy (“Service-Related Messages”). When you opt into the Service you agree to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. We may also modify these Mobile Terms at any time upon notice. If you do not agree to the changes, you must stop using the Service.
By voluntarily opting into the Service, you agree: (i) that you are over eighteen (18) years of age; and (ii) to receive recurring SMS/MMS text messages from and/or on behalf of John Hardy, and/or its agents or vendors, through your wireless provider to the mobile number you provided at the time you voluntarily opted into the Service, even if your mobile number is registered on any state or federal Do Not Call list. You acknowledge that the SMS/MMS text messages you receive may be sent using an automatic telephone dialing system or other similar technology. Service-Related Messages may include, but are not limited to, order updates, account alerts, etc. Promotional Messages may include, but are not limited to, promotions, specials, deals, abandoned cart reminders, other marketing offers, etc.
You understand that you do not have to opt into the Service in order to make any purchases, and your consent is not a condition of any purchase with John Hardy. Your participation in the Service is completely voluntary.
We do not charge for SMS/MMS text messages received through your voluntary participation in the Service, but you are responsible for all charges and fees associated with SMS/MMS text messages that are imposed by your wireless provider. Message frequency varies, and we reserve the right to adjust the frequency of messages at any time. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to the SMS/MMS text messages received through the Service, including charges from your wireless provider. Some wireless providers may not be able to support the Service and supported wireless providers may charge from time to time.
If you do not wish to continue participating in the Service at any time, or no longer agree to these terms, you must text the single keyword command STOP to 844.641.1440 or click the unsubscribe link (where available) in any text message. You may receive a one-time opt-out confirmation text message, as well as instructions on how to rejoin the Service. No further SMS/MMS text messages will be sent to your mobile device, unless you voluntarily rejoin the Service.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any SMS/MMS text messages, including any STOP or HELP requests, you send to a short code or telephone number we have transitioned away from, and which we have notified you of, may not be received and we will not be responsible for honoring requests made in such messages.
The wireless providers supported by the Service are not liable for delayed or undelivered SMS/MMS text messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new mobile number.
To the extent permitted by applicable law, you agree that neither we nor any wireless provider supported by the Service will be held liable for failed, delayed, or misdirected delivery of any information or content sent to you through the Service, any errors in such information or content, and/or any action you may or may not take in reliance on the information or content sent through the Service.
Any mobile number that you provide us and/or consent you provide to receive SMS/MMS marketing text messages from us will not be shared or transferred to any third parties for marketing or promotional purposes.
